1. About Forthword
Forthword is a legacy journaling app designed for parents to write time-locked entries for their children. You can share meaningful messages, memories, and guidance that will be delivered to your children at dates you choose. The Service is provided by Forthword, Inc.
2. Acceptance of Terms
By using Forthword, you represent and warrant that:
- You are at least 18 years of age or have parental consent
- You have read, understood, and agree to be bound by these Terms
- You have the authority to enter into this agreement
- Your use of the Service complies with all applicable laws and regulations
3. Account and Responsibilities
When you create a Forthword account, you agree to:

- Maintain the confidentiality of your account credentials
- Be responsible for all activity that occurs under your account
- Notify us immediately of any unauthorized access
- Keep your contact information updated

4. Acceptable Use
You agree not to use Forthword to:
- Create content that is illegal, abusive, harassing, or threatening
- Upload viruses, malware, or any code intended to harm the Service
- Interfere with or disrupt the Service or servers connected to it
- Reverse engineer, decompile, or attempt to gain unauthorized access to the Service
- Collect or track personal information of others without consent
- Use the Service for commercial purposes or to compete with Forthword
- Violate any applicable laws or regulations

5. Intellectual Property Rights
Your Content: You retain all ownership rights to the journal entries and messages you create in Forthword ("Your Content"). By using the Service, you grant Forthword a non-exclusive, worldwide, royalty-free license to store, process, and deliver Your Content as needed to operate the Service and fulfill your requests.
Service Content: All other content in the Service, including text, graphics, logos, and software, is owned by Forthword or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or transmit this content without written permission.
6. Subscription and Billing
Pricing Tiers:
- Free Tier: Create and store up to 10 journal entries
- Premium Tier: Unlimited entries and advanced features (pricing varies by region)
Payment Processing: All subscriptions and in-app purchases are managed through Apple App Store and processed via RevenueCat. By purchasing a subscription, you authorize Apple and RevenueCat to charge your payment method. You can view, modify, or cancel your subscription through your Apple Account settings at any time.
Recurring Billing: Premium subscriptions renew automatically unless you cancel. You will be charged for the renewal period according to the terms of your plan. Refunds are subject to Apple's refund policies.
Changes to Pricing: Forthword may change subscription pricing with 30 days' notice. Changes will take effect at your next renewal date.
7. Termination and Account Deletion
You may delete your Forthword account at any time through the app settings. Upon deletion, your account will be deactivated, but Your Content may be retained for a limited period to fulfill delivery obligations or as required by law.
Forthword may suspend or terminate your account if you violate these Terms or engage in harmful behavior. We will attempt to notify you of termination unless circumstances prevent us from doing so.
Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination, such as intellectual property and limitation of liability, will continue.

9. Disclaimers and Limitations of Liability

Limitation of Liability: To the fullest extent permitted by law, Forthword shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to Forthword in the 12 months preceding the claim.
Service Availability: While we strive to maintain service reliability, Forthword does not guarantee uninterrupted or error-free service. We are not responsible for delays, disruptions, or failures caused by circumstances beyond our reasonable control.

Forthword uses third-party services, including RevenueCat for subscription management and Apple's infrastructure. Your use of the Service is subject to the terms and conditions of these third-party providers. Forthword is not responsible for their services or policies.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction of such courts.

Forthword may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and posting the revised Terms. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the changes, please stop using the Service.
